These conditions determine the procedure for ordering, payment, delivery and reclamation of products offered on the website “botun.hr”. By accessing this page, it is considered that the Customer has read these Terms of Business, understood them, and that the Customer accepts them with his order or purchase of products.

General provisions

ordering or sending inquiries for products via www.botun.hr is possible 24 hours a day, 7 days a week. The seller is BOTUN trade for trade, production and services Vl. Sanela Škorput Headquarters: 10000 Zagreb, Jablanska ulica 50. OIB: 28241042413.

The buyer of the products sold by the Merchant is any natural person who purchases the products through the Merchant’s online store in the manner regulated by these Terms. The buyer is considered to be any natural and / or legal person who selects at least one product of the Merchant, puts it in the cart, sends the order to the Merchant and pays immediately or by cash on delivery. The buyer can only be an adult and able-bodied person. The contract in the name and on behalf of the minor and completely incapable persons may be concluded by their legal representatives or guardians. Partially able-bodied persons may conclude a contract only with the consent of their legal representative or guardian. The Merchant does not bear any responsibility for acting contrary to this provision. The product is any item located on botun.hr and is marked with the price and item number (code).

Images and product information

Images and descriptions are not necessarily identical to the product. The trader reserves the right to make errors in the description and images of the product. Product images are illustrative in nature and the image illustrating the product on the website may not fully correspond to the actual appearance and content of the product. Product images are shown to the customer only for the purpose of informing and approximating the characteristics of the product, without guaranteeing equality. The trader undertakes to try as much as possible to ensure the up-to-dateness and accuracy of the information on the website, especially in relation to the price of the products and services offered. The merchant is not responsible for any errors in the description of the product, images and errors caused by changes in prices and page updates. In the event of such an error, and especially if the price displayed on the website for any reason would not correspond to the actual price of the product, the Merchant will immediately notify the Buyer, and allow him to cancel or change the order. due to the described error of the Merchant, the Merchant will return the money paid to the buyer as soon as possible, and no later than 7 (seven) days from the date of notification of the Buyer about the cancellation of the order.

Ordering

The customer can order the product 24 hours a day, 7 days a week. Products are ordered via an electronic form. If BOTUN is not able to deliver the ordered product or any of the ordered products, BOTUN will contact the Customer by phone or e-mail, and inform him about it. In that case, the order will be canceled or executed for those products that are available.

After the User finds the product he wants to buy, he must first select the size of that product (a size guide for each product is located next to the specified product). Then you need to click on “Add to Cart”. If the size has already been determined for the product then just click on “Add to Cart”. The user can continue to search and add more products to the cart or can continue with the order. After adding all selected products, the User selects the “Cart” option. At that moment, the user will be able to select the entire shopping cart overview and review their order, add or remove products, ie regulate their quantity or complete the purchase. At the moment when the User is satisfied with the final content of his shopping cart, he selects the option “Complete the purchase” to continue the order process.

Delivery

Delivery is performed by the Seller through authorized courier services, post office or own delivery. Products can also be picked up at the Seller’s branch. The product will be delivered to the customer in the territory of the Republic of Croatia within 8 working days (Saturday, Sunday and non-working days excluded) from delivery of the product to the delivery service, to the customer at an address within the European Union within 15 working days ) from delivery of the product to the delivery service, to the customer at the address within the United States within 15 working days (Saturday, Sunday and non-working days excluded) from delivery of the product to the delivery service, and to the customer at the address within the Republic of Serbia and Bosnia and Herzegovina within 15 working days (Saturday, Sunday and non-working days excluded).

The seller does not guarantee during delivery after delivery of the shipment to the authorized person to pick up the shipment by the courier service. We will try to deliver all ordered products in one package, ie in one shipment. If the above is not possible, the Seller reserves the right to deliver in several shipments

When picking up the delivered package, the Buyer is obliged to inspect the delivered product. It is necessary to check for visible external damage to the package and / or to the product itself.

In case the product has external damage, the Buyer is obliged to immediately inform the delivery officer (submit a complaint), and refuse to take over the delivered product (s). The buyer is obliged to open the shipment in front of the delivery person and compare the delivered products with the delivery note, and if something is missing or products that have not been ordered are delivered, immediately report them to the delivery person.

In the event that the product delivered to the Customer is different from the one he purchased, the Customer is entitled to a new delivery of the ordered product. If this is not possible, the Buyer has the right to terminate the contract. The Customer will be refunded in the amount of the paid price of the product in the manner in which he made the payment, except when choosing the method of cash on delivery, where the funds will be returned to the Customer’s bank account. Funds are paid after the Seller receives the returned product (s). The seller bears the cost of returning the product.

If the Customer does not take over the product or refuses to take over the product without a valid reason, BOTUN reserves the right to demand reimbursement of handling, transport and other possible costs.

When BOTUN delivers the product to the Buyer through the delivery service, the Buyer is obliged to pick up the product by signing the delivery note, which confirms that the product has been properly delivered.

Payment

The customer can pay for the ordered products and services in one of the following ways:

2.) credit and / or debit cards: if it has an application. Payment directly via the Internet, using the card payment service: Visa, MasterCard or Maestro, via the Raiffeisenbank E-ToMiTreba application.




If the Buyer chooses to pay by payment slip or internet banking, at the end of the ordering procedure, an offer will be sent to him by e-mail with all the information needed to make the payment. In case the buyer intends to pay for the goods by payment slip or internet banking, the payment deadline is 48 hours from the confirmation of the order. After this period, the Merchant cannot guarantee the condition of the warehouse and the availability of the ordered items, so the order confirmation becomes non-binding for the Merchant and the Buyer’s order is deleted from the system, ie it is considered canceled. Order processing starts from the moment the payment is visible on the Merchant’s account.

Data privacy statement

The data of a natural or legal person (name and surname, company name, address, contact phone number, e-mail of the Buyer and payment information) are available to the Seller and the Seller undertakes to keep the data carefully, in accordance with the applicable Personal Data Protection Act and other relevant regulations. .Data of a natural or legal person is known only to the competent persons who perform the necessary procedures in order to carry out the purchase and sale of products successfully and correctly. If the data stated in these Terms of Sale are not entered, it will not be possible to make an inquiry or purchase a product through botun.hr. Data is managed manually and IT. The data submitted to the Seller may be forwarded to specialized companies and organizations that perform data processing services on behalf of the Seller, in relation to which each Buyer gives his explicit consent through ordering / purchasing Products through botun.hr and accepting these Terms.

Complaint and refund

Our goal is for each product to arrive in excellent condition and to be delighted with the purchase.

If you receive a product in a damaged condition or if it does not match the description, please download the Complaint Form, fill it out and send it to email: modniateljebotun@gmail.com BOTUN undertakes to respond to your complaint within 15 days. Complaints will be considered justified if the product inspection and, if necessary, additional expertise, determines that it meets the conditions for complaint in accordance with the Civil Obligations Act and the Consumer Protection Act. If it is established that the complaint is justified, BOTUN undertakes, where possible, to replace the product with an identical one without defects, to make repairs or return the entire amount of money for which the product was purchased. If it is found that the complaint is not justified and the complaint is rejected, you will have to bear the cost of re-delivery of the purchased product to your address. Your refund must arrive at the studio within 14 days of delivery. We recommend that you book a product collection within 7 days of the delivery date to make sure it arrives at the appropriate location within 14 days.

Returned items must comply with BOTUN product return rules:

all products must be returned unworn, undamaged and unused, with all markings, accessories and original packaging

Be careful when trying the product, and if you want to return it, please return it in the same condition in which you received it. Most of the products on BOTUN are limited or unique and therefore require special attention. Unfortunately, any refunds that do not meet the above conditions will not be accepted. You bear the cost of the refund yourself.

After BOTUN receives and verifies the return in accordance with the product return policy, we will contact you.

You must prove that your right to unilateral termination of the contract is in accordance with the provisions of the Consumer Protection Act.

If your refund is accepted, you will be refunded in the manner in which the payment was made, except in the case of cash on delivery, where the funds will be returned to your bank account that you previously indicated to us.

If your refund is not accepted, your product will be resent to your designated address, and you will bear the cost of shipping yourself.

Written customer complaints and disputes

These Terms and Conditions have been prepared in accordance with the Consumer Protection Act and other regulations of the Republic of Croatia. Buyers may send their written complaints about the Merchant’s products or services to the Merchant’s address: Jablanska ulica 50, Zagreb, by mail or e-mail to: modniateljebotun@gmail.com as stated in the Merchant’s information.

The Merchant is obliged to confirm without delay that it has received the written complaint of the Buyer, and no later than 15 (fifteen) days from the date of receipt of the written complaint to respond to it. otherwise the court in Zagreb has jurisdiction. Pursuant to Regulation no. 524/2013 of the European Parliament and of the Council, there is an obligation for retailers participating in online sales contracts to provide on their website an electronic link to the online consumer dispute resolution platform. Exclusion of liability

BOTUN reserves the right to change, modify, supplement, update or limit these General Terms and Conditions and data protection provisions or any information on the botun.hr website at any time and without prior notice; this provision also applies to improvements or amendments to products, services. By using the botun.hr site by the Buyer, it is understood that the Buyer is aware of all changes and that the Buyer understands and accepts them. If the Buyer does not agree with the Terms of Business, he will refrain from using the botun.hr website. Seller excludes liability for any damage caused to Buyers or third parties as a result of such changes.
